Terms of Service

1. The service
TestMyVibes ("TMV") is operated by Samia Harris Enterprises, Inc. (Canada). We provide AI- and human-driven QA testing of web applications. You ("Customer") submit a URL + description; we run tests against it and return reports.
2. Your account
- You must be 18+ to open an account.
- You're responsible for keeping credentials + API keys confidential. Notify us at support@testmyvibes.com of any suspected compromise.
- One person or business per account. No sharing.
3. Acceptable use
You may submit URLs for testing only when you have the legal right to test that target. Specifically, you must NOT submit:
- URLs you do not own or have explicit written permission to test.
- Targets that would constitute unauthorized access under the CFAA, the UK CMA, the Canadian Criminal Code, or equivalent.
- Sites whose terms of service prohibit automated testing.
- Content involving CSAM, terrorism, sanctions-listed entities, or other illegal material.
We may suspend or terminate accounts that violate this section without refund.
4. Credits + billing
- Tests are priced in credits. 1 credit = $0.10 USD (volume discount at the $450 pack).
- Credits expire 90 days from purchase if unused.
- Refunds: credits are non-refundable once tests have been queued. Stripe charges may be refunded within 7 days if no tests have been submitted.
- Worker payouts to human checkers are paid in USD via Stripe Connect, weekly auto-payout on Sundays.
- We may change pricing with 30 days' notice; existing credit balances are honored at the rate paid.
5. Test outputs + your data
The reports, screenshots, and action trails generated for your account are yours. We retain a copy for 30 days for retest + audit purposes (see Privacy Policy).
6. AI agent disclosures
AI test runs use OpenAI's GPT-4o + GPT-4o-mini models. Screenshots of your target URL are sent to OpenAI to drive the agent's decisions. By submitting a URL you grant TMV the limited right to send screenshots + descriptions to OpenAI for the duration of the test. We do not train any model on your data.
7. Warranty disclaimer
The service is provided "as is". We don't warrant that tests will surface every bug your application has — manual + automated testing is complementary, not exhaustive. Specifically, the Legal Eagle agent produces a regulatory-exposure scan that is NOT legal advice — consult a qualified attorney before acting on its findings.
8. Limitation of liability
To the maximum extent permitted by law, TMV's liability for any claim is capped at the amount you paid us in the 12 months preceding the claim. We're not liable for indirect, consequential, or punitive damages.
9. Indemnification
You agree to indemnify TMV against claims arising from your use of the service in violation of Section 3 (Acceptable Use).
10. Termination
You may close your account at any time via account settings. We may suspend or terminate accounts that violate these Terms. On termination, unused credits are forfeit except where required by law.
11. Governing law
These Terms are governed by the laws of British Columbia, Canada. Disputes are resolved in the courts of Vancouver, BC.
12. Changes
We may update these Terms; material changes get 30 days' email notice. Continued use after the effective date constitutes acceptance.
